These Terms of Service (“Terms”) govern your access to and use of the BrandPeak platform, website, dashboards, and related services (the “Service”) operated by BrandPeak Pte. Ltd., a company incorporated in Singapore (“BrandPeak,” “we,” “us,” or “our”).

By using the Service, you agree to these Terms and our Privacy Policy.

1. The Service

BrandPeak provides AI search visibility monitoring and analytics tools.

The Service analyzes publicly available information and AI-generated responses to generate brand visibility insights and reports.

BrandPeak provides analytical insights only and does not guarantee rankings, inclusion, traffic, performance, or commercial outcomes.

2. Accounts

To access certain features, you must create an account.

You agree to:

• Provide accurate information
• Maintain the security of your login credentials
• Be responsible for activity under your account

You must be at least 18 years old.

We may suspend or terminate accounts that violate these Terms.

3. Acceptable Use

You agree not to:

• Use the Service for unlawful purposes
• Interfere with or disrupt the Service
• Attempt to reverse engineer or access underlying source code
• Circumvent technical protections

4. Ownership

BrandPeak retains all rights in the Service, including its software, technology, data models, and platform infrastructure.

You retain rights to the information and materials you submit to the Service.

Reports and outputs generated through your authorized use of the Service are provided for your internal business use and client reporting purposes.

BrandPeak may process submitted information to operate and improve the Service, in accordance with our Privacy Policy.

5. Third-Party Platforms

The Service analyzes outputs from third-party AI systems and digital sources.

BrandPeak:

• Does not control those platforms
• Is not affiliated with or endorsed by them
• Cannot guarantee the accuracy or stability of third-party outputs

Results reflect a point-in-time analysis.

6. Subscriptions and Payment

Certain features require a paid subscription.

Subscriptions renew automatically unless cancelled before renewal.

Fees are non-refundable except where required by law.

We may update pricing with reasonable notice.

7. Data Storage

BrandPeak uses cloud infrastructure located in the United States. By using the Service, you consent to the transfer and storage of data in the United States.

8. Disclaimer

The Service is provided on an “as available” basis.

To the extent permitted by law, BrandPeak disclaims warranties, including warranties of accuracy, completeness, and fitness for a particular purpose.

The Service provides informational and analytical insights. Decisions based on such insights remain your responsibility.

9. Limitation of Liability

To the fullest extent permitted by law, BrandPeak is not liable for indirect or consequential damages, including loss of profits, data, or business opportunity.

BrandPeak’s total liability for any claim shall not exceed the amount you paid in the three (3) months preceding the claim.

10. Changes to Terms

We may update these Terms periodically. Continued use of the Service after changes constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of Singapore. Any disputes shall be subject to the exclusive jurisdiction of the courts of Singapore.
